Juffrou Ansie Terms and Conditions

These terms and conditions (“Terms”) govern your use of Juffrou Ansie, an online education platform (the “Platform”), provided by Juffrou Ansie (“Company,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

1. User Accounts

• Eligibility: You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are 18 years of age or older.
• Registration: To use certain features of the Platform, you may need to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Account Security: You are responsible for maintaining the security of your account. You agree not to share your login credentials with others and to notify us immediately of any unauthorised use of and/or access to your account.

2. Content

• User-Generated Content: Users of the Platform may submit, upload, or post content, including but not limited to lesson plans, assessments, and comments. You are solely responsible for the content you submit and any consequences of posting such content. Any and all images, text, or other content you upload or include in your resources must adhere to copyright laws and intellectual property rights. We do not take any responsibility for ensuring the copyright compliance of your uploaded content. Users must ensure that all images and information within their resources are either their original work, have the necessary permissions for use, or are in the public domain. Juffrou Ansie will not be held liable for any copyright violations associated with user-generated content. Additionally, it’s important to note that any lesson plans, assessments, or written content you create or modify on Juffrou Ansie are for your personal use within your classroom. These resources may not be resold, redistributed, or claimed as your own work.
• Rights: By posting content on the Platform, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Platform.
• Prohibited Content: You agree not to post content that is illegal, infringing, defamatory, harassing, harmful, or otherwise violates these Terms.

3. Subscription Packages and Payment Terms

As of December 17th, 2024, all subscriptions have been discontinued. Any active subscriptions prior to this date will be cancelled automatically and end at the conclusion of their current billing cycle. Users will not be charged further, and all products/services are now available as one-time purchases. For inquiries regarding past subscriptions, please contact our support team at info@juffrouansie.co.za. All purchases on our website are processed as one-time payments. Payment details will not be stored for any recurring billing purposes.

4. E-Commerce Resource Library

• Product Format: All digital products are provided in PDF format unless explicitly stated otherwise in the product description. Certain resources may be offered in an editable Word format as a separate paid add-on, subject to the Editable Licence terms set out in Clause 24.
• Access to Digital Products: Purchased digital products are accessible via your account on the website. It is your responsibility to secure your account credentials to prevent unauthorised access.
• Product Issues and Adjustments: If a product contains a mistake, users must inform us so we can review it. However, it is at our discretion whether or not to make adjustments, and such adjustments will only be made if deemed reasonable and appropriate.

5. Platform Access and Availability

We do not guarantee uninterrupted access to the Platform and reserve the right to suspend access for maintenance or technical reasons.

6. Intellectual Property

• Platform Content: The Platform and all its content, including but not limited to text, graphics, images, logos, and software, are the property of the Company and are protected by intellectual property laws. You may not use, modify, or distribute any content from the Platform without our prior written consent.
• Our system allows a user to be logged into their account from one device at a time, adding an extra layer of security. Notify us promptly of any unauthorised access to your account.

7. Inspiration Station

• The content provided in the Inspiration Station is intended as general guidance and inspiration. It may not be suitable for every individual or situation.
• Juffrou Ansie is not liable for any decisions, actions, or outcomes resulting from the use of content provided in the Inspiration Station.
• The Inspiration Station content is provided “as is” and without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• While we strive to provide accurate and up-to-date information, Juffrou Ansie does not guarantee the accuracy, completeness, or reliability of any content provided. Users are encouraged to consult relevant professionals for specific advice.
• Under no circumstances will Juffrou Ansie be held liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Inspiration Station or its content.

8. Privacy

Privacy Policy: Our collection and use of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy for information about our data practices. By accessing or using this Platform, you consent to the terms of our Privacy Policy.

9. Termination

• Termination by Us: We reserve the right to terminate or suspend your account and access to the Platform at our own discretion, with or without cause and with or without notice.
• Termination by You: You may terminate your account at any time by contacting us or following the account termination process on the Platform.

10. Modifications

We reserve the right to modify, update, or discontinue any part of our website, including content, products, services, and pricing, at our sole discretion and without prior notice. Users are responsible for regularly reviewing these Terms for updates. Continued use of the website constitutes acceptance of any changes.

11. Professional Use Disclaimer

• Juffrou Ansie does not market assessment materials as secured or pre-exposed classroom assessment instruments, and does not encourage learner access to assessments intended for formal classroom administration prior to use.
• The educational resources, including assessments and lesson materials, provided on the Platform are designed to support educators in their professional practice. While these resources may be used within formal teaching and assessment contexts, educators remain responsible for ensuring that all materials are used in accordance with applicable school policies, curriculum requirements, assessment programmes, and departmental guidelines. Juffrou Ansie does not replace the professional judgement, moderation processes, or statutory responsibilities of educators or schools.

12. Quality Assurance and Corrections

While we strive to maintain high standards of accuracy and quality, errors may occasionally occur. Users are encouraged to report any identified errors. Where appropriate, corrections will be made, and updated versions may be provided. The existence of errors does not imply negligence but forms part of an ongoing quality improvement process.

13. Errors, Interpretation, and Continuous Improvement

While Juffrou Ansie endeavours to provide accurate and high-quality educational resources, educational content may be subject to interpretation and contextual application. Errors or omissions may occur from time to time. Users are encouraged to report any identified errors. All reported concerns are reviewed as part of an ongoing quality improvement process. The identification of an error does not invalidate the educational intent of the resource, nor does it remove the responsibility of professional judgement and contextual adaptation by the educator.

14. Use by Non-Educators

• The Platform may be accessed by parents, tutors, and other non-educators. While these resources may support learning at home, they are not a substitute for professional teaching, assessment moderation, or curriculum planning. Juffrou Ansie does not assume responsibility for the interpretation or implementation of educational resources by non-professionals.
• The Platform may be accessed by educators, parents, tutors, and other users. Certain resources, including assessment materials, may therefore be available to multiple parties. Educators remain responsible for exercising professional judgement when selecting, adapting, timing, and implementing assessment resources within their classrooms, including managing assessment integrity and fairness. Juffrou Ansie does not control or restrict access to resources by individual user groups and cannot be held responsible for prior exposure to materials outside of the classroom context.

15. Public Access vs Public Domain

• Although certain resources may be accessible online, all content remains protected by intellectual property laws and does not enter the public domain. Access to the Platform does not grant permission for unrestricted use, reproduction, distribution, modification, or resale.
• Educational resources provided on the Platform are intended to support teaching and learning within appropriate professional and educational contexts. Responsibility for the selection, adaptation, and implementation of resources within classroom or assessment settings remains with the educator or responsible adult, in accordance with applicable school policies and regulatory frameworks.

16. Statement of Source Referencing and Disclaimer

Note: Any YouTube videos, Vimeo content, or online resources suggested in this plan are included solely as recommended supplementary teaching material. All videos remain the intellectual property of their respective creators or organisations. Juffrou Ansie, including all employees, claims no ownership thereof, and these are not resold, repackaged, or presented as original work within this material. Teachers are encouraged to use them only as external educational resources, with proper acknowledgment of the original source.

17. Refund and Returns Policy

• Refunds and Returns for Subscriptions: At Juffrou Ansie, we are dedicated to providing our users with high-quality services and products. Due to the nature of our subscription-based services, we do not offer refunds or accept returns for subscription purchases.
• Subscriptions have been discontinued. For one-time purchases, refunds or cancellations are subject to our general refund policy.
• E-commerce products – Digital Product Policy:
  • No refunds or exchanges will be provided for digital products.
  • If you receive the incorrect item, it is your responsibility to notify us immediately so we can address the issue.
  • Ensure you carefully review the product description and details before completing your purchase.
• Order Cancellation and Misuse of Products: We reserve the right to cancel orders at any time. If you purchase a product and share or sell it without our consent, we reserve the right to:
  • Cancel any and all future orders from you.
  • Terminate your subscription immediately.
  • Block you from accessing our website.

19. Limitation of Liability

• Juffrou Ansie provides educational resources in good faith to support teaching and learning. While we take reasonable care in the development and review of our materials, the Company does not guarantee that resources will be suitable for every educational context, learner group, or assessment setting.
• To the fullest extent permitted by law, Juffrou Ansie shall not be liable for any direct or indirect loss, assessment irregularities, academic consequences, or professional outcomes arising from the use, adaptation, timing, or implementation of resources obtained through the Platform.
• Use of all resources remains subject to the professional judgement, moderation processes, and institutional policies applicable to the user’s educational context.
• Under no circumstances shall Juffrou Ansie be liable for indirect, incidental, consequential, or special damages arising from the use of the Platform or its resources.
• The Company does not warrant that all content is factually exhaustive, free from error, or applicable to every educational context. Educators remain responsible for verifying and contextualising information where required.

20. Classroom Implementation

Juffrou Ansie does not supervise, control, or participate in the classroom implementation of its resources. The Company cannot be held responsible for how resources are presented, administered, timed, modified, or contextualised within individual classrooms or learning environments.

21. Educational Content, Accuracy, and AI-Assisted Development

• Juffrou Ansie develops educational resources to support teaching and learning across a range of subjects and contexts. While we take reasonable care in the creation, review, and quality control of our materials, educational content may include interpretation, exemplification, or generalisation, particularly in subjects such as language, literacy, and skills-based learning.
• Some resources may be developed or supported using digital tools, including artificial intelligence, as part of our content development processes. While such tools can enhance efficiency and creativity, they may occasionally produce inaccuracies, omissions, or generalised outputs. All content is reviewed by human educators as part of our quality assurance processes; however, absolute accuracy or suitability for every educational context cannot be guaranteed.
• The Company does not warrant that all content will be error-free, factually exhaustive, or universally applicable. Users remain responsible for exercising professional judgement when interpreting, adapting, or applying educational content within their specific teaching, learning, or assessment contexts.

22. Sensitive and Contextual Topics

Some educational resources may reference historical, social, cultural, or linguistic topics that are subject to interpretation or may be sensitive in certain contexts. Such content is included for educational purposes only and does not represent endorsement of any particular viewpoint. Educators are encouraged to apply professional judgement when presenting or contextualising such material, taking into account the age, maturity, and background of learners, as well as school policies and community norms.

23. Curriculum Interpretation

References to curriculum alignment, including CAPS or ATP, are provided as general guidance. Final interpretation, sequencing, weighting, and application of curriculum requirements remain the responsibility of the educator or institution.

24. Editable (Word) Resources

Certain resources may be offered in an editable Word format as a separate paid add-on. Where you purchase an editable resource, the following terms apply in addition to all other terms in this agreement:

• Copyright remains with Juffrou Ansie. Purchasing the editable version grants you a licence to edit and use the resource; it does not transfer ownership or copyright to you. The intellectual property provisions in Clauses 6 and 15 continue to apply.
• You may edit, adapt, and modify the resource and use it for your personal classroom and teaching purposes, in the same manner permitted for our PDF resources.
• You may not use the resource, in its original or edited form, for any commercial purpose, including selling, reselling, licensing, or otherwise profiting from it.
• You may not share, distribute, or make the resource available to others outside your own classroom, whether in original or edited form, via any platform or means. The misuse provisions in Clause 17 apply.
• Once you edit or modify the resource, the edited version becomes your responsibility. Consistent with Clauses 12, 13, and 21, Juffrou Ansie’s quality assurance applies only to the original, unedited resource as supplied, and Juffrou Ansie is not responsible for any errors or inaccuracies introduced through editing.
• You may not claim the resource, or any edited version of it, as your own original work.

25. Artificial Intelligence and Automated Systems

You may not use, upload, submit, or incorporate any Juffrou Ansie resource, in whole or in part and whether in its original or edited form, into any artificial intelligence system, machine learning model, or automated tool, including for the purposes of training, validating, testing, fine-tuning, or generating outputs. You may not use any resource to develop, train, or improve any artificial intelligence or machine learning application. This restriction applies to all resources, including those provided in editable format.
